This determination was not based on site conditions and the type of scaffold being erected or dismantled: On or about July 9, 2018, Unit #3 penstock, employees performing scaffold dismantling were exposed to fall hazards where the employer did not provide safe means of access for each employee dismantling a scaffold. |

29 CFR 1926.62(l)(1)(i): The employer did not include lead in the program established to comply with the Hazard Communication Standard (HCS) (� 1910.1200). The employer did not ensure that each employee has access to labels on containers of lead and safety data sheets, and was trained in accordance with the provisions of HCS and paragraph (l) of this section: On or about August 6, 2018, gallery stairwell and elevator, employees were working in the area of a lead containing particulate trough which contained lead at a level of approximately 350-540 micrograms surface lead and 0.03 milligrams trough particulate content lead and the employer did not label containers of lead in the work area. |
