On my credit reports with XXXX, XXXX, and XXXX is a repossession from Volkswagen Credit , Inc. with a deficiency balance of {$2000.00}.
I previously disputed this account information in XXXX 2015 with all XXXX credit reporting agencies and Volkswagen Credit , Inc. verified the accuracy of the account with all XXXX credit reporting agencies.
I then sent letters directly to Volkswagen Credit , Inc. to attempt to resolve this matter. It should be noted that each credit bureau lists a different contact address for Volkswagen Credit , Inc. which obviously complicates the resolution process. Of the XXXX letters sent, XXXX was returned to me by the USPS as an invalid address ( which is a violation of the FCRA for a creditor to fail to provide proper contact information in a credit report ) and the other XXXX letters were ignored. These letters were sent Certified Mail, Return Receipt and I received confirmation of delivery for the ones delivered.
A subsequent follow-up letter was also ignored.
On XXXX XXXX, 2015 I sent Volkswagen Credit , Inc. another letter, to their Collections/Recovery/Credit Reporting department in XXXX, XXXX. In that letter, I reminded them of their obligations : Under the laws of the State of XXXX, the Uniform Commercial Code, and State RISA and MVISA statutes : A deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to.
I requested such documentation be provided within 14 days, as is my right.
As no such documentation was received by me within the allowed time-frame, the alleged claim of a deficiency is considered null and void, and any continued collection activities, or continued reporting of this invalid claim on my credit reports will be considered a violation of the FDCPA and FCRA.

I XXXX, XXXX XXXX requested a loan payoff for the account on XX/XX/XXXX and the loan payoff was posted to the online message box on XX/XX/XXXX. The loan payoff letter was received in the mail on XX/XX/XXXX. The loan payoff is due by the XXXX. On XX/XX/XXXX the first letter of instructions ( claim of credit ), XXXX, federal reserve XXXX XXXX and XXXX, and the negotiable instrument of the loan payoff endorsed was sent to the CFO over night and was received on the XXXX at XXXX pm ( letter of instructions states XXXX business days will be given to receive a response. A copy of the endorsed negotiable instrument of the loan payoff was sent to the billing center requested in the letter that was sent to XXXX XXXX. The first correspondence from Volkswagen credit was post marked XX/XX/XXXX and said they received my correspondence on XX/XX/XXXX. The second set of instructions that was sent to the CFO ( opportunity to cure ) along with POA, federal reserve section 16 and 29, and the negotiable instrument of the loan payoff endorsed on XX/XX/XXXX giving XXXX business days to respond. Volkswagen correspondence was postmarked XXXX and said my correspondence was received XX/XX/XXXX. The third set of instructions was sent on XXXX ( default of notice ) along with POA, federal reserve XXXX XXXX and XXXX, and the negotiable instrument of the loan payoff endorsed. Again, given XXXX business days to respond accordingly. Their correspondence was postmarked XX/XX/XXXX and said my correspondence was received XX/XX/XXXX. All of my instructions were sent overnight using XXXX with tracking. Also, all items sent had to receive a signature upon delivery. A copy of this file complaint and all evidence has been sent to the CFO as well. As of XX/XX/XXXX the instructions have not been completed by the CFO at this time. As of now the CFO of Volkswagen credit Inc. is in violation and breach of contract of the following laws/acts : 15 USC 1611 , 3-602, 3-603, 3-604, 3-611, 3-408, 3-409, federal reserve act section 16, and federal reserve act 29. Due to the nature of the violation, I am seeking remedy of the full contract to be paid out for the account with Volkswagen credit Inc. and 1 percent of the total assets of Volkswagen credit Inc. member bank.

My husband is a XXXX XXXX XXXX who is currently XXXX. Vw Credit financial has denied my husband and I our SCRA rights and have threatened to repossess our vehicle since we fell on hard times during his XXXX. They do not have a SCRA department or reposession department that we are able to get in touch with and has been giving us the run around. They know about the SCRA law, because they have been asking us to voluntarily surrender the vehicle instead of coming to take it ( since we live on the XXXX XXXXXXXX XXXX XXXX ). They are denying a court order as well.

My loan with VW Credit originated in the State of XXXX. End of XXXX, I moved to XXXX XXXX. Since XXXX I have been trying to get a state transfer to my local County Office that handles auto registration. I spoke with XXXX at VW Credit who stated it was electronic, but he would have this info sent on XX/XX/2021. No info arrived to my Clerk 's office so I then called and spoke with Manager XXXX on XX/XX/2021.
VW Finance will not send the document I need to transfer my car and get it registered in XXXX.
This is ridiculous, I have already went thru two temporary license tags.

I XXXX XXXX, Consumer, experienced a depressing moment in my life when On XX/XX/2022, Volkswagen Credit XXXXnc, Repossessed my vehicle unlawfully the night before a workday. Volkswagen Credit Inc. allowed a third party to retrieve my vehicle without my permission for them to disclose my personal information to a third party without a contract in place between myself and the third party. On XX/XX/2022, Volkswagen Credit Inc. received a request for information letter from myself sent certified mail return receipt for the following information ( proof that Volkswagen Credit Inc. repossessed my vehicle in accordance with the law : " I demand proof that the repossession of the subject vehicle was legal in accordance with the following U.C.C : 9-506. Effect of errors or omissions XXXX XXXX XXXX. Notification before disposition of collateral- KRS XXXX XXXX. Timeliness of notification before disposition of collateral- KRS XXXX XXXX. Contents and forms of notification before disposition of collateral- KRS XXXX XXXX. Explanation of Calculation of Surplus or Deficiency- KRS XXXX I am also requesting a statement of accounting pursuant to U.C.C 9-210. '' I am patiently waiting for Volkswagen Credit Inc. to respond to my request. The 14 day window that they had to provide me with the information was up today XX/XX/2022. I have yet to receive the requested information from Volkswagen Credit. They also furnished to my consumer credit report our transaction history which is a violation of 15 U.S. Code 1681a. This was an Unlawful repossession has caused me mental anguish, XXXX, character, and mode of living. Volkswagen Credit Inc, has violated my rights as a consumer.

Hello, My name is XXXX XXXX XXXX and I recently had to return a leased vehicle.
The vehicle a Volkswagen CC R Line, had only 20 miles and gorgeous car. I was pushed to lease the car when I really wanted to buy a car. I was also told that the more money down the less monthly payment, so I paid XXXX out of my 401k right up front. In XXXX we received a letter about the XXXX airbag recall and that our vehicle was being recalled.
On XXXX XXXX XXXX I returned the vehicle to XXXX XXXX in XXXX, KY. They were more than rude because we were not extending or buying the vehicle. I asked if we could have some kind of price reduction and review on the monthly payments since the vehicle had depreciated so much and I was forced to literally drive a ticking time bomb with a defective airbag for the whole term of the lease, even if the recall of the vehicle was not disclosed until later. I drove a vehicle that was not worth the price it sold for or leased for.
VWCredit did not care to even waive the return fee of XXXX nor the property tax remaining of XXXX.
There has to be some kind of refund on the original price.

As there are only XXXX characters permitted to describe the issue, I will try to make this brief : I previously filed a CFPB complaint against Volkswagen Credit in XXXX. They offered no resolution in their response as they said they could not find/identify my account. This complaint XXXX XXXX XXXX was in regards to a deficiency balance XXXX claimed was owed ( and which was being reported on my credit reports ) that I claimed was invalid. After nearly 10 months of fighting and providing documentation, Volkswagen Credit finally ( on XXXX XXXX, XXXX ) sent me a letter acknowledging the account was in fact paid in full as of XXXX XXXX, XXXX. I have attached a copy of that letter.
On XXXX XXXX, XXXX I sent a follow-up letter ( dispute ) to Volkswagen Credit. I have attached that letter as well. As I pointed out in that letter, while I appreciated the removal of the inaccurate deficiency balance, the payment history and account status being reported to the credit bureaus was inaccurate, impossible ( no way to go from on-time to 90-days late in one month ), and incredibly damaging to me. I provided copies of all the credit reports, explained why the reporting was inaccurate, and asked that Volkswagen Credit either correct the payment history and account status OR verify to me that the account history is correct ( as they have previously done when disputed through the credit reporting agencies ) and provide me with a copy of the ledger/payment history as what is being reported is wildly different than what my records show. I received a written response from Volkswagen Credit dated XXXX XXXX, XXXX. That letter is also attached. In that response, Volkswagen Credit acknowledges receipt of my letter and states that an update has been submitted to the credit reporting agency. I was told these changes could take 30 days. So I waited.
As of today, the only change has been to XXXX XXXX. The payment history detail has been deleted entirely, yet the pay status still shows as Pay Status : Account Paid in Full, was a Repossession and the account includes the following Remarks : Dispute Investigation Compete. Reported by Grantor. Transferred to Recovery. Paid Repossession.
What was transferred to recovery, as there was never a deficiency balance due?
Neither XXXX nor XXXX received any update at all to the payment history, Account Status, nor Remarks.
Volkswagen Credit is willfully reporting inaccurate information to the credit reporting agencies. I have disputed this inaccurate information through the channels provided by the credit reporting agencies and Volkswagen Credit has verified the information as accurate and correct.
I have disputed the accuracy of this information directly with Volkswagen Credit and was told updates would be sent to the credit reporting agencies. This 'update ' was sent to XXXX of the XXXX credit reporting agencies and even that only fixed a portion of the inaccurate data.
At this point, the continued reporting of ( and verification of ) inaccurate information in my credit bureau files constitutes a violation by Volkswagen Credit under the Fair Credit Reporting Act.
I sent Volkswagen Credit a follow-up letter dated XXXX XXXX, XXXX also attached. I demanded either all inaccurate and negative information be deleted from all XXXX credit bureaus leaving a positive/closed account OR the entire trade-line be deleted. That letter was ignored and no changes occurred.
I warned Volkswagen Credit I would file a Consumer Financial Protection Bureau complaint, which I would follow with a XXXX complaint and complaints with the XXXX of Oregon ( where they are located ) and Pennsylvania ( where the original transaction occurred ) and that I would also seek any compensation to which I may be entitled under the Fair Credit Reporting Act. I do not want things to have to proceed beyond this first step.
