Complaint What Happened Ok so I purchased a vehicle in XX/XX/XXXX of 2017 and was financed with Consumer Portfolio Services. Everything seemed fine, and admittedly I was late making the XX/XX/XXXXpayment partly due to difficulties trying to pay them via phone. I decided ultimately to pay the bill by check through the mail. In XX/XX/XXXX a check was mailed to CPS. I never received any sort of correspondence from CPS regarding not receiving payment nor a bill for the month of XX/XX/XXXX. I was going to send a check for payment of the month of XX/XX/XXXX and then woke this evening to find that the vehicle was not in my driveway. I attempt to call CPS upon this realization and can get no actual person other than a recording. I then access the companies website and access statements sent to me and find that the only thing sent to me according to their website is the bill fore XX/XX/XXXXand nothing else. I have received no phone calls, no further mail, no email and they do have my contact information both personal and work. All attempts to contact CPS have been exhausted as this is sort of an emergency due to the fact that I do have medication inside the vehicle that was just filled yesterday and I have no way of getting it replaced due to law. No attempt was made to afford me the opportunity to retrieve personal belongings from the vehicle which I am especially bitter about. I then find that their website shows that my account was not credited for payment sent in XX/XX/XXXX. After further research I found that this is not an isolated incident and that this sort of problem seems to be rather normal for the company 's operation. I have also submitted a complaint directly to the company but have n't heard anything from them regarding this. The complaint was submitted today.

Complaint What Happened I have an auto loan through consumer portfolio services. In XXXX XXXX, my husband lost his job and we are no longer able to afford this loan. CPS offered to defer some auto loan payments and I declined. I advised a voluntary surrender was best for my situation. I received a notice in the mail yesterday, CPS processed a due date change moving my payment out 30 days and extending the loan even after I advised I ddi not want this to happen. It appears in XXXX CPS was fined for unilaterally modifying contracts and other illegal business practices resulting in them paying the FTC XXXX XXXX in fines and penalties. I believe the practice I described above is continued unilateral modification of contracts without my consent. On XXXX/XXXX/XXXX, I called CPS and spoke directly with a man named XXXX XXXX at XXXX ext XXXX or direct number of XXXX who advised he would forward my file for voluntary surrender. I have attempted to contact this company regarding the " due date change '' they claim they processed on this loan to no avail.

Complaint What Happened I am filing this complaint because I feel that I have been violated in one way or another by Consumer Portfolio Services INC. also referred to as " CPS INC '', under the following Federal Laws that have been set forth to protect me as a consumer in the United States. In XX/XX/XXXX, I received notice that CPS INC. was actively seeking a summary judgement against me in the amount of {$6300.00}, which consist of {$4900.00} in regards to the principal balance and {$1300.00} interest. The plaintiff in this case NO. XXXX and I have been going back in forth in XXXX County XXXX Court and I have to be honest, I have simply done the back and forth motion in court to buy myself time and to prevent the default judgement to be entered against me because I simply can not afford to be sued. After the last motion/Pro Se answer form I filed in XXXX XXXX where I stated that I would only be able to afford around {$20.00} or so dollars per month I knew my time had ran out. Therefore I began to look up and research the laws of the FTC. I feel that CPS INC. has violated in one way or another following consumer laws ; Section 5 of the Federal Trade Commission Act ; the Fair Debt Collection Practices Act ; and the Fair Credit Reporting Act, in the following ways. In XX/XX/XXXX I purchased a XXXX XXXX XXXX and CPS INC became my indirect loan servicer when they bought my loan from XXXX XXXX XXXX. XXXX XXXX in XXXX, XXXX My first payment was due in XX/XX/XXXX and it was made on time. It did not take too long from the beginning of the term of the loan for it to became a living nightmare. I do not have all dates and times however I do recall very vividly that once my loan got behind meaning '' less than 30 days and in some instances more than 30 days I was threatened that if I did not pay a certain dollar amount via XXXX XXXX XXXX pay for an additional charge ( {$12.00} ) that " they would come get my van '' so obviously I paid the said dollar amount and fee because I have kids and a job to get to. I was asked on more than one occasion to release the " where abouts '' and condition of my van. If it was '' behind a locked gate, in a car garage ect. I am almost certain that I was called from various phone numbers " departments '' within CPS INCXXXX because I had their main/public contact phone number stored in my contacts. I am sure they called me at my job as well however I am not going to state that as factual information. I know that at some point while I was making payments I was offered a deferred payment furthermore I was never asked to sign a loan modification agreement. Once I got really far behind due to job loss, I knew that by then that there was no way for me to catch up on the deficient amount. I know that on more than one occasion I simply asked the CPS INC. representative within the repossession department the intended date of repossession so that I could be prepared to have all my personal belongings out of it, however that date was never released and I did not know until the repossession company hooked up my van and them came to my door to let me know they were fixing to leave and in the event that I had any personal belongings in the van I could get them out or call CPS INC. to see how much I needed to pay in order for the repossession company to release my van from the truck it was hooked on. I had already gotten all belongings out at that point and I knew there was not way to pay the past due therefore I did not see any need to contact CPS INC. to inquire about the amount needed to avoid my van being repossessed because I knew there was no way I could even " put a dent '' on the balance owed. The following information I am going to disclose is only known to me due to the current active court case I am involved in with CPS INC. in XXXX County Court Case No. XXXX where I am the defendant. CPS INC. sent " Notice for plan to sell vehicle '' dated XX/XX/XXXX and then the " Explanation of calculation of surplus or deficiency '' dated XX/XX/XXXX once my van was sold at auction. I now have the " Sale Contract '' dated XXXX well as the " Expense Detail Sheet '' dated XX/XX/XXXX that I obtained while going back and forth in XXXX County Court. I feel that this lawsuit was brought forth in XXXX because I hired a credit repair agency called XXXX XXXX XXXX out of XXXX KY after being denied a mortgage and referred to this agency for help with my studnet loans XXXX. I know this debt was disputed however I was never given a copy of said dispute in XXXX and when I requested a copy of the dispute from XXXX XXXX XXXX in XX/XX/XXXX so that I could see what the dispute consisted of, the owner of XXXX XXXX XXXX. XXXX XXXX stated that there was no reason for me to have access to those dispute letters basically saying that they were out dated. I advised XXXX of the reasoning and he stated that he no longer has records from 2 years ago. Sometime in XX/XX/XXXX I called CPS INC. to obtain a copy of the explanation and calculation of the surplus or deficiency per XXXX and was questioned by the rep with CPS INC. where I was working and how my job loss is what prevented me from making payments and now that I have a job I can make the payments. I soon began receiving collection calls from CPS INC. This led me to look more closely at the updated credit reports from my records from 2 yrs ago and I have now found were this debt in reference to CPS INC. account number XXXX has been reported as follows ; charged off, closed and filed in a my chapter XXXX bankrucpty that was filed in XX/XX/XXXX and I did not obtain the van until XX/XX/XXXX. I would like to be able to see all the statements that CPS INC. sent me while I had the van in my possession to look more closely at the pay off balance, interest paid, principal paid and fees accessed to my account because the ledger I now have due to court case documents does not make a whole lot of since to me. My credit reports also show that this debt was never sold to a collection agency however it was listed as the above referenced status with the 3 CRA 's. The ledger which is attached shows multiple line postings, two {$12.00} posting inwhich I believe are in relation to the XXXX XXXX XXXX pay fees that I had to pay in order for them to not repossess my van, these can be seen on XX/XX/XXXX and XX/XX/XXXX line postings.

Complaint What Happened I had bought a car from XXXX XXXX dellership in XXXX of 2021 XXXX weeks after i bought it the clutch went out on the highway and the car was in the emergency lane and then towed of the road by XXXX to a parking lot on XXXX XXXX in XXXX ky i was told it had a full drivetraine warenty by XXXX XXXX and even with this in writing thay said it was not i was left in a parking lot for seven hours unitill a friend got off of work and came and pick me up i am a XXXX veteran who is XXXX XXXX XXXX this is how veterans are treaded in XXXX ky the finance companey Consumer Portfolio Services they were contacted that day the warenty and the dellership as well no one never made atemp to pick this car up a month and a half later the car still had not got pick up and soon came up missing i have try for weeks after the car went down to get help and got no help from no one i filled a police report and turn over the info to Consumer Portfolio Services with my insurance info for XXXX XXXX times the clame as of this day has still never been filled and i am getting harrast by them and by the insurance and the dellership there is foul play going on here from one of if not all three of them i don't have this car i have follow all laws they have the ones with shady past look up there history it speeks for itself i have contacted your office so many times for help still getting treated like XXXX by the credit bureas it did no good contacting you for help with them i was told you can handle this if i don't get some kind of help to get these low life criminals off my back i will take it public and filled a criminal complaint with the XXXX XXXX of the DOJ so i am asking one more time to help me this is what this office was set up to do

Complaint What Happened I have had an ongoing problem with Consumer Portfolio Services XXXX XXXX XXXX, XXXX, California. XXXX I lost my job in XX/XX/XXXX, got behind on payments 3, moved out of XXXX due to a XXXX XXXX situation. Moved to XXXX KY, got a new job XXXX XXXX caught up payments, then in XX/XX/XXXX needed XXXX XXXX XXXX off work XX/XX/XXXX to XX/XX/XXXX, got behind again, 3 payments, went into prerecovery from XXXX XXXX XXXX XXXX , XXXX XXXX, XXXX , Florida XXXX XXXX I have talked to XXXX , XXXX , XXXX , Ms XXXX, XXXX , XXXX , Ms XXXX , supposedly a supervisor, now address change for payments to : XXXX XXXX XXXX, XXXX XXXX , CA XXXX as of XX/XX/XXXX. The last supervisor I talked to at Pre-Recovery was XXXX XXXX, I told him I thought there was a discrepancy in my cash payments made at XXXX here in XXXX, according to my records not all my payments were posted to my balance, Also they gave me he said 5 extentsion and then they kept that payment due current on the loan rather than on the end of the loan as they told me they would do. I asked him for time to get an attorney and have him help me with this process, he got angry the first time I confronted him about this problem and hung up on me. Then a few days later he called me back wanted another XXXX payment from me, I told him no more money until I was certain that my balance was correct ( that I still owed ). So I communicated with him by e mail. He said you voluntarily surrendered the car, and I said not until I am certain that the balance owed is correct. and I would only communicate by e mail with them. NO MORE PHONE CALLS. They called and heavy breathed in to the phone, acted like they were mafia. Asked me to buy a lottery ticket and maybe I would win and pay off my loan. I was asked to go to all the area churches up here and beg them for a car payment. Churches help with food, AN TO VALUE is to high so no one will refinance. I tried 3 different banks. I went back to original XXXX electric and water bill, and sometimes rent if you are on a court ordered eviction. NO ONE will give you money for a car payment. The estimated value of the car is now {$8000.00}. I went back to original dealership in XXXX XXXX, KY and they would not get me into another car since CPS handles most of their loans, I went to XXXX XXXX XXXX, KY. when they go the info on the LTV they turned me down also. So now the XXXX XXXX XXXX XXXX was just repossessed. I am XXXX, I live alone, have no other method of transportation and just recently had XXXX and I told them I would make all the necessary payments to bring the loan current, when I got my unemployment, my enhanced unemployment, a nd my stimulus help and then I would voluntarily surrender the car and get another one and that I would complain to CFPB, Inspector General of the US, Attorney General of state of Kentucky and Attorney General of State of Tennessee. I know this complaint won't help me but I hope to get the word out there about this fraudulent loan company and prevent other people from being duped by CPS and XXXX.

Complaint What Happened I purchased XXXX XXXX XXXX in XXXX of XXXX, first payment due XX/XX/XXXX. The loan I got was a fresh start loan after a bankruptcy that had not been finalized yet. My old car a XXXX XXXX transmission was going out. I got the loan at 18.45 % interest. I lost my job in XX/XX/XXXX and was a victim of XXXX XXXX and relocated to XXXX, KY in XX/XX/XXXX. I have been unable to find a job other than XXXX at XXXX per hour. I am XXXX XXXX XXXX. I have had problems with making that {$400.00} per month payment. In XXXX of XXXX I was diagnosed with severe XXXX of my XXXX and the XXXX XXXX recommended XXXX. I waited another year and worked in XXXX XXXX every day to try to keep this car payment up to date. I did get behind 3 months and worked hard approximately XXXX hours per week. In XXXX of XXXX I had to take a leave of absence the rtindoctor stated my XXXX was grinding XXXX to XXXX and I had to have XXXX to have a total right XXXX XXXX. I did have XXXX XX/XX/XXXX. I notified Consumer Portfolio Services that I needed XXXX and I would be off several weeks recuperating and that I would not be able to make my payments on time and did they have a hardship program. I was told no. When I bought the car I questioned the high rate of interest, the finance manager at XXXX XXXX in XXXX XXXX in Kentucky told me that I could get the car refinanced to lower my payments and interest in a couple of years. I believed this. So in XXXX I tried XXXX XXXX XXXX and was turned down since my loan to value was too high. My car then was valued at around XXXX and the loan pay off was still XXXX The car purchase loan amount was for XXXX. So after almost 2 years my balance had only gone down approximately XXXX. So I went back to XXXX XXXX in XXXX XXXX in XXXX of XXXX and asked them to please get me into a different car with lower payments. They told me they could not put me in a different car due to the same reason XXXX XXXX had denied me. So now that I am behind XXXX, XXXX, and XXXX payments they are threatening repossession. I know this may not help me with this situation but I hope others can be warned about XXXX XXXX in XXXX XXXX and their unfair lending practices and Consumer Porfolio Services out of XXXX California, my payments go to XXXX Arizona and the call about repossession came from XXXX, Florida

Complaint What Happened We were one payment behind at beginning of 2019, we had help from loan company in past due to me being out if work several months after XXXX XXXX XXXX. We had automatic payments set up from XX/XX/2919 until car was paid off. CPS states they presented for payment in XXXX and bank declined for insufficient funds, however bank manager states payment was not presented. I have a print out of payments made from XX/XX/2019 to XX/XX/2019. I spoke to Mr XXXX at CPS and stated we could possibly make a payment on XX/XX/XXXX, but my husband VA doesn't come to bank until XXXX XXXX one reason pmts were set up for that date. I am scheduled to work XXXX to XXXX but usually dont get off work until after XXXX. I would call CPS numbers left in voice mails to me only to get the reps voicemail, leave a message and them call me while I was at work and couldn't answer phone. Call back when I can get voicemail leave message, and repeat fir several days until I finally reached Mr. XXXX. Come to find out CPS had canceled our automatic payments with out notifying us. I have billing statements from XXXX, XXXX and XX/XX/2019. On XX/XX/XXXX CPS had the car repossessed, repo rep had no paperwork, would not give phone number, and only stated his name was XXXX and hes taking the car to XXXX XXXX. I called CPS to get automated messages to call back during business hours, called next day and spoke to 3 representative and a supervisor. Supervisor was rude and I dont remember his name. I spoke to a XXXX, XXXX and a XXXX. We were told we could get car back if we paid {$2300.00} plus the towing fee of {$390.00} and what ever the storage adds up to. Was told by one rep we have until XX/XX/XXXX to get car or it goes to auction in XXXX area, another rep said we had one week and car would be sent to auction, We have received no notice in the mail from CPS, I know they must notify us of date, time and place of auction. I know CPS has been fined for deceptive practices and I feel we are a victim of that now. CPS also said payoff for car is {$16000.00} tho all the paper work I have shows {$15000.00}, which means payments we have made have mostly went to internet and not the principal as when we first got the car the principal was just over {$15000.00}.

Complaint What Happened I opened my auto loan with Consumer Portfolio Services in XX/XX/XXXX. I made my first payment in XX/XX/XXXX. As of today, XX/XX/XXXX, there have been 18 monthly payments made at {$500.00}. This totals {$9000.00}. In that same 18 month period, {$6400.00} has been applied to the interest on the loan and {$2500.00} has been applied to the principle. Somehow, 18 monthly payments on a {$17000.00} auto loan has reduced the principle balance to {$15000.00}. I would like the CFPB to investigate this. I can not figure out any way where 71.9 % of all payments should be going to interest while 28.1 % go to the principle. This car will never be paid off if that is the case.

I am requesting the original assignment contract to validate this account. I have requested this numerous times with no follow up from CPS. Complaint What Happened I have been paying on my XXXX XXXX XXXX for a while now, roughly a year possibly longer. I feel behind due to an unexpected death in the family, which lead to being evicted and homeless sleeping out of my vehicle trying to figure out how I can make money. I have been paying the car company every month trying to get caught up o my car payment, and I find it really unbelievable and so unfair they are now threatening to repo my vehicle if I dont pay {$350.00} by the end of the month which i unfortunately have rent due also and need to keep a roof over my childrens head. But how is it fair I pay CPS the company who bought my debt without consent, is threatening to come take something from me that I HAVE been paying on! down payment on? They didn't disclose my right to resend consumer credit transaction and they made me pay out of pocket for insurance. Which is supposed to be included in the finance charge. They also illegally charged me a down payment.
