Complaint What Happened We have the property for sale with an agency, The XXXX XXXX XXXXXXXX in Florida since XXXX. Previously it was with XXXX XXXX XXXX from XX/XX/XXXX to XXXX have had many sale contracts that all get cancelled because the property does not pass inspection. It is now listed cash only, As XXXX, short sale. Up until XX/XX/XXXX, we had someone keeping up with landscape and keeping inside house clean for visits. Then the lender mortgage company, without warning, changed all the locks, broke the side window door and put up some plywood to quick fix. Rain in Florida infiltrated and caused water damage inside house. With every sales contract, there is an inspection and appraisal. The lender had these done but won't forward the results to our agent. The last sales contract could not get an appraiser and while revisiting house, noticed all the water damage around the broken window door and cancelled sale. Our agent signed another sale contract with closing date set for XXXX XXXX. The lender said that if the buyer doesn't have all needed for XXXX AND we have to sign a promissory note of {$17000.00}, the property goes to foreclosure. At the moment, it is very difficult to get an XXXX. There is a big difference between their appraisal and ours.

Complaint What Happened To whom it may concern : I have tried to work with my mortgage company and after failing to respond they denied my request for help because they placed a foreclosure sale date. I offered them a down payment for over half of what I was due after I file bk to stop the foreclosure sale date. Now they are refusing to give any updates. I don't have an attorney and I am trying to do everything I can to work with them. My counselor XXXX XXXX has also reached out to the current single point of contact XXXX XXXX. She has denied to communicate. We have advised them several times that there is no foreclosure attorney.

Complaint What Happened My mortgage holder XXXX XXXX XXXX and XXXX XXXX allowed me to go in to a COVID-19 Forbearance XXXX of XXXX for up to 18 months + 6 months. They honored XXXX and XX/XX/XXXX. XXXX XXXX XXXX then sold my mortgage to XXXX XXXX XXXX XXXX XXXX XXXX, XXXX for XXXX XXXX XXXX XXXX and SN Financial Corporation Mortgage Servicer XXXX XXXX XXXX. I was never notified of the new mortgage holder changes until XX/XX/XXXX when SN Financial Corporation contacted me by email and letter telling me that my mortgage was in foreclosure. I contacted XXXX XXXX my new account specialist at SN Financial Corporation and told her that I was in a COVID 19 Forbearance agreement with XXXX XXXX and XXXX XXXX XXXX why am I in Foreclosure and who is SN Financial Corporation? She said they bought my mortgage from XXXX XXXX and XXXX XXXX XXXX XXXXXX/XX/XXXX and she has no knowledge of the mortgage being in a COVID 19 Forbearance with the previous mortgage holder or servicer. I was given 10 days to make at least 2 full payments to keep my home from being foreclosed on and I scraped the payments up and paid SN Financial Corporation. The Foreclosure was enforced again in XX/XX/XXXX and I mailed SN Financial Corporation 2 full payments certified mail and the payments were returned to me. XX/XX/XXXX XXXX XXXX from SN Financial Corporation called me and asked if I could pay double payments and a lump sum to catch up. I told her that I just received my second Ky Unemployment benefits payment that was in the amount of {$10000.00} and that I could give them {$8000.00} and pay a full payment and a half. After I told her what I could do, I was never contacted again until XX/XX/XXXX with a court date for summary judgement foreclosure. I had contacted TeamKy HAF and completed my application but SN Financial Corporation never responded to the TeamKy HAF Counselor. XX/XX/XXXX Judge XXXX XXXX in XXXX XXXX Kentucky Circuit Court ruled in favor for Summary Judgement. i was immediately facing an imminent homelessness so I filed for XXXX XXXX the day of the sale ordered by the judge in XX/XX/XXXX with the help of a lawyer. I couldn't get all the things done for the Bankruptcy with everything else happening so the Bankruptcy was dismissed and now the sale is in effect again for XX/XX/XXXX. Ordered by XXXX XXXX Kentucky Circuit Court XXXX XXXX XXXX. I was completely devastated financially when XXXX XXXXXXXX XXXX Implemented the manditory COVID-19 Business Shut Down that ended my XXXX XXXX XXXX XXXX XXXX XXXX Worst was that I was approved for Ky Unemployment but I never was funded/paid my desperately needed benefits for over a year. Then when I was paid it was only for 6 weeks from XXXX. Was suppose to be 46 weeks. It was several months later before I received anything else from Ky Unemployment. I had no way to pay for my mortgage especially with XXXX XXXX and my father that's a retired XXXX veteran, whom I still taking care of in my home currently. Please help me stop the sale of my home. It's XXXX and we can't even enjoy it for a third year in a row. I have been so stressed over this matter that I went in to the XXXX XXXX with XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX Please help us!

Complaint What Happened On this reported date, XX/XX/XXXX received, XX/XX/XXXX, XXXX XXXX XXXX, transferred my loan to SN SERVICING CORPORATION, inaccurately reported to the Credit Bureau, my loan or account status as : Loan modified NOT under a federal government plan. According to the credit bureau report ( attached file ), YOU'VE CHANGED MY LOAN MODIFICATION WITHOUT my consent!!! This move is illegal and I've filed a complaint with the Consumer Financial Protection Bureau ( CFPB ), Attorney General, XXXX XXXX of The State of California where XXXX XXXX XXXX and SN SERVICING CORPORATION headquarter 's are located. I've also filed a compalint with Attorney General, XXXX XXXX of The State of Kentucky where I live. Both XXXX XXXX XXXX and SN SERVICING CORPORATION have FAILED to honor MY ORIGINAL loan modification agreement ( attached ) with XXXX, the orignal servicer. This credit report is proof that XXXX XXXX XXXX and SN SERVICING CORPORATION have FAILED to honor mortgage servicing rules requiring the old servicer, XXXX XXXX XXXX to send the new servicer, SN SERVICING CORPORATION any information showing the CURRENT STATUS of discussions with the borrower, ME regarding a loan modification, WHICH XXXX XXXX DID NOT DO -- I HAVE NOT SPOKEN TO XXXX nor HAS XXXX TRIED TO CALL ME!!!! and UNDER FEDERAL RULES, the new servicer, SN SERVICING CORPORATION MUST also have policies and procedures in place ( WHICH OBVIOUSLY THEY DO NOT HAVE IN PLACE ) to ensure that it HONORS ( WHICH IT HASN'T ) EXISTING loan modification agreements ( attached ). Further violations : On XX/XX/XXXX, according to the NOTICE OF ASSIGNMENT, SALE OR TRANSFER OF SERVICING RIGHTS ( attached & highlighted ) from the old servicer, XXXX XXXX which stated " NOTHING ELSE ABOUT YOUR MORTGAGE LOAN WILL CHANGE '', well obviously this ISN '' T TRUE according to the attached credit bureau reports WHICH STATES : " Loan modified NOT under a federal government plan '' AND " Foreclosure process started ''!!!! This NOTICE OF ASSIGNMENT, SALE OR TRANSFER OF SERVICING RIGHTS CONTAINS NO LOAN NUM BER FOR the new servicer SN SERVICING CORPORATION. Secondly, I've received no monthly statements showing what my balance is and what I should pay monthly on my mortgage even though this same NOTICE OF ASSIGNMENT, SALE OR TRANSFER OF SERVICING RIGHTS which contains NO LOAN NUM BER, states " SN SERVICING CORPORATION WILL START ACCEPTING PAYMENTS RECEIVED FROM YOU on XX/XX/XXXX. '' Since both you, XXXX XXXX XXXX and SN SERVICING CORPORATION signed an XXXX ; you are both required to follow the guidelines within the Making Home Affordable ( R ) Program Handbook for Servicers of Non-GSE Mortgages, Version 5.2. THE ABOVE IS AN INACCURATE ENTRY ON MY CREDIT REPORT per the Making Home Affordable ( R ) Program Handbook for Servicers of Non-GSE Mortgages, Version 5.2 ; Specifically SECTION 12.2 Credit Bureau Reporting : that states, '' Servicers should report a " full file '' status report to the credit reporting agencies for each loan under HAMP in accordance with the Fair Credit Reporting Act as well as other applicable laws and credit bureau requirements as provided by the Consumer Data Industry Association ( CDIA ). " Full-file '' reporting means that the servicer must describe the exact status of each mortgage it is servicing as of the last business day of each month. '' First of all, Since SN SERVICING CORPORATION acquired this loan from XXXX XXXX XXXX on XX/XX/XXXX and I received the notification in the mail of the transfer, I have not heard from SN SERVICING CORPORATION. They have not mailed me my monthly statements showing what my balance is and what I should pay monthly on my mortgage even though the NOTICE OF ASSIGNMENT, SALE OR TRANSFER OF SERVICING RIGHTS which contains NO LOAN NUM BER, states SN SERVICING CORPORATION would start to receive payments from me on XX/XX/XXXX. There has been no introduction of a relationship manager to this date. If they did call me, they didn't leave a message. Please mail me my MONTHLY statements, showing what my balance is and what I should pay monthly on my mortgage. If you had consistently mailed me monthly statements, then I would know what to pay and you wouldn't need to make the following inaccuracies : PLEASE CORRECT ON MY CREDIT REPORT ASAP. SINCE YOU HAVE NOT FOLLOWED THROUGH ON THE FOLLOWING, THEN YOU'RE IN VIOLATION OF SECTION 9. Permanent Modification, OF THE Making Home Affordable ( R ) Program Handbook for Servicers of Non-GSE Mortgages, Version 5.2 ; Specifically SECTION 9.4 Re-default and Loss of Good Standing, Paragraph 4. MAINLY this section : " In the event a borrower defaults on the modified loan, the servicer must work with the borrower to cure the modified loan ( YOU HAVE NOT DONE THIS ). If this is not possible the servicer must-evaluate the borrower for any other loss mitigation alternatives, e.g., HAFA ( YOU HAVE NOT DONE THIS ), prior to commencing foreclosure proceedings ( YOU HAVE DONE THIS ). All of the above are VIOLATIONS of the MHA Handbook Version 5.2 SECTION 3 Protections Against Unnecessary Foreclosure ; SECTIONS 2.2 and 3.4 of Chapter II, respectively. Also, this is a VIOLATION of the MHA Handbook Version 5.2, Chapter IV. Home Affordable Foreclosure Alternatives Program ( HAFA ), Specifically SECTION 3 HAFA Consideration that state : '' Borrowers that meet the eligibility criteria for HAMP but who default on a permanent HAMP modification should first be considered for other loan modification or retention programs ( YOU HAVE NOT DONE THIS ) offered by the servicer prior to being evaluated for HAFA. Notwithstanding the foregoing, Consumer Financial Protection Bureau ( CFPB ) Regulations may require a servicer to consider a borrower for HAFA contemporaneously with considering the borrower for HAMP and other home retention options. '' How can this be when SN SERVICING CORPORATION HAS NOT tried to work with me per the MHA Handbook Version 5.2 Guide?

Complaint What Happened Due to the covid protection I filed months ago requesting assistance/help in paying my mortgage. I filled out the appropriate paperwork with my mortgage company. I continue to contact them and all they tell me is there is no information. They state there is no way for me to check the status of my requests either. We are now months after I submitted this assistance/request and still nothing from my mortgage company. I thought there was supposed to be assistance for people struggling with income and not being able to make mortgage payments.
