My private loan through sallie mae now navient went into default in XX/XX/XXXX. I was charged 16 percent interest initially in XX/XX/XXXX when my credit was at a very positive status. I had to get a loan to cover the existing balance that my federal loans did not cover.
I was told in XX/XX/XXXX by an 3rd party agent that if I didnt make a large sum payment that there would be legal action taken immediately at that point made a XXXX dollar payment. I was continually making payments to my loan the best I can til I lost my job. They offered me a 0 percent repayment option and I was unable to come up with a large sum of money that the agency requested. Then recently through another agency they offered me 0 percent repayment without a down payment. why wasnt this offered to me in XX/XX/XXXX?
Navient will not give me any concessions and I asked repeatedly for documentation since my loan originated. It took months to years and no one would get that info til recently. Ive paid thousands and thousands in this loan and still accruing interest. I was told by many attorneys that this loan is a scam. When I request info they tell me to refer to the agency because theres not anything they ( navient ) can do. When I talk to the agent, they tell me to refer to Navient. Its old!
Can you please help me? I want to come to a positive solution on this. And also would like to consider a civil lawsuit if possible. And understand that Navient has many legal action lawsuits against them currently.

My previous Income Driven Repayment Plan was {$66.00}.
I joined XXXX XXXX and my monthly salary significantly decreased so I updated my Income Driven Repayment Plan on XX/XX/2017 to lower my monthly payments which should have been decreased to {$0.00} a month. I provided all documents including proof of income and was told over the phone my payments would in fact be {$0.00} a month due to my low income. On X/XX/2017 my repayment plan was approved but had increased to {$180.00} and was automatically withdrawn from my bank account on X/XX/2017. I contacted Navient to ask why my payment plan had increased when in fact should have decreased to {$0.00}. I was told to resubmit the Income Driven Repayment Plan Request form and proof of income. I submitted the documents on X/XX/2017 and on X/XX/2017 my request was approved but only after financial hardships living on such a low salary.

My student loans have been in forbearance or deferment status since I graduated in 2011 because they have not offered me a monthly payment amount that I can afford. I have tried to apply for income based multiple times, but they encouraged forbearance. Now the interest is almost up to the total I owe, around {$56000.00}. In looking at income based repayments, my total will go up over {$30000.00} just so I can afford a payment. My wife also has outstanding student loan payments and we can not afford hers and mine at this time. They have not been helpful and now I have a missed payment on my credit report because they did not enter a forbearance request in a timely manner. In addition to all this, my degree came from XXXX XXXX, which has now just down for improper practices and fraud. I believe they were working with XXXX XXXX to purposely make my loans default.

How is this legal? at best I would think its discriminatory? how's it fair to people paying on their loans and people who just said XXXX it I'm not paying then they get relief and people who've been paying do not? I called Navient today trying to get my payments reduced. They only offered me an " interest only '' option of {$160.00} or a standard repayment of {$220.00}. At the end, they also offered to refinance my loan through another company. I've been paying on this loan for YEARS and still have many years to go. I feel as if I am being taken advantage for a loan I've had since XXXX. The payments are too high for me and navient is unwilling to offer affordable options. My original loan is {$10000.00} and my current balance is ~ {$20000.00}. The interest on the loan each month is {$160.00}. I am just a XXXX XXXX XXXX with a XXXX XXXX XXXX child and husband trying to do the best I can. This company is ruthless, heartless, and selfish.

I originally accepted a federal student loan through XXXX XXXX for about {$20000.00}. The loan was assumed by Navient from XXXX XXXX and I have repaid almost {$18000.00} towards the original loan amount. However, Navient claims I owe them over {$24000.00} still. This is more than the original loan amount that I have been paying on for over 20 years. This is mathematically impossible for a loan with an 8.25 % interest rate. I have had several " forebearances '' that were applied to my account by Navient without my consent and that have made the payoff amount out of reach. I have also been told they are compounding the interest daily, and even though I have paid over {$300.00} a month for almost 20 years, they claim I am deeper in debt than when I originally took out the loan. I would be glad to settle the loan for a reasonable amount but I am not repaying double the original loan amount. Please provide some arbitration or legal assistance with this matter. Navient is well-known for handling federal student loans with very questionable practices that has led to the deception of millions of American taxpayers and they have stolen millions from the students of this country in the name of the federal government. They should be already have been prosecuted criminally for these actions but I really just want to be able to pay-off my loan for a reasonable amount. Please intervene and stop Navient from continuing to perform these types of practices.

My loans originated in XXXX with XXXX to attend XXXX University Online. I was granted a forbearance in XX/XX/XXXX, XX/XX/XXXX, before I made any payments. I called for help because spouse had lost job. I believed my loans to be Federal loans that would be able to get Nursing forgiveness but found out my loans were ineligible. I was never, by XXXX, Sallie Mae or Navient, told I could consolidate my loans into a Direct loan that would qualify for forgiveness. I wasnt made aware of that until last year when Covid came and I didnt qualify for the payment pause or 0 % interest. I did some research and emailed a lot of politicians to complain and listened to multiple XXXX videos. In XXXX of XXXX I completed a Direct consolidation loan and have applied for XXXX. They are telling me I have made 7 qualifying payments right now. I began paying on my loans XX/XX/XXXX with XXXX at $ XXXX. In XX/XX/XXXX they were transferred to Sallie Mae. In XX/XX/XXXX, I called due to financial hardship and was offered forbearance for 6 months from XX/XX/XXXX to XX/XX/XXXX, which was later extended to XX/XX/XXXX, which was extended to XXXX XXXX. In XXXX, I began payments in XXXX to XXXX when I began filing Ch XXXX bankruptcy which was discharged XX/XX/XXXX. My loans were transferred to Navient at some point in XXXX. I resumed payments XX/XX/XXXX and continued until XX/XX/XXXX. I was furloughed due to the Covid Pandemic in XX/XX/XXXX when I called Navient to see if I qualified for the payment pause or 0 % interest I was told my loans were NOT federal loans and did not qualify and they offered me 6 months of forbearance. During all these years trying to pay these loans and years of forbearance no one explained income driven plans ( and still havent ) and during all but 2 of these years, I received NO increases in salary. I have researched and seen that XXXX had to repay billions in loans for bad practices, XXXX University students have gotten loan forgiveness because of the schools bad practices. Now Sallie Mae/Navient are having to discharge loans. I have no way of knowing if my loans are in the ones Navient will forgive. Mine are currently with XXXX and awaiting to see if they count more of my payments as qualifying for XXXX. I have worked at a qualifying hospital for almost 25 years. I was financially XXXX by Sallie Mae & Navient for years. I currently owe XXXX. My original loan balance was XXXX. The payments I have made have all been approx XXXX or more/month. I want to know if my loans should have been included in the XXXX forgiveness or will they be included in the Sallie Mae/Navient debacle.

Last year there was a lawsuit announced regarding the Attorney General XXXX XXXX XXXX XXXX XXXX XXXX Navient. Also, there were also XXXX State Attorneys General announced a {$1.00} Billion Settlement with Student Loan Servicer Navient private loans. However, I was eligible for private loan debt cancellation because the school I attended was on the list. The private loan debt relief will primarily go to borrowers who took out private subprime student loans ( made to borrowers with low credit scores ) through Navients predecessor, XXXX XXXX, between XXXX and XXXX, and then had more than seven consecutive months of delinquent payments prior to XX/XX/XXXX. In addition, the list of these for-profit schools is shown in the attachment below.
The settlement was led by XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX
However, I applied and still wasn't able to get my loan canceled in this lawsuit. In addition, Navient will pay {$140.00} XXXX to the attorney general. A total of {$95.00} XXXX in restitution payments of about {$260.00} each will be distributed to approximately XXXX federal loan borrowers who were placed in certain types of long-term forbearances. Yet, borrowers who will receive restitution or debt cancellation span all generations : Navients harmful conduct impacted everyone from students who enrolled in colleges and universities immediately after high school to mid-career students who dropped out after enrolling in a for-profit school in the early to XXXX.
On the other hand, this settlement includes conduct reforms that require Navient to explain the benefits of income-driven repayment plans and to offer to estimate income-driven payment amounts before placing borrowers into optional forbearances. Additionally, Navient must train specialists who will advise distressed borrowers concerning alternative repayment options and counsel public service workers concerning XXXX XXXX XXXX XXXX ( XXXX ) and related programs. The conduct reforms imposed by the settlement include prohibitions on compensating customer service agents in a manner that incentivizes them to minimize time spent counseling borrowers. Navient will also cancel more than {$1.00} XXXX in subprime private student loans owed by approximately XXXX borrowers nationwide. Californians will receive around {$260.00} XXXX of that debt cancellation, going to approximately XXXX borrowers.

I sent the email below to Navient on XXXX XXXX XXXX to have them take off an unauthorized forbearance on my accounts that had been placed without my permission. I received a template letter on XX/XX/XXXX stating that they would look at the situation and never heard back again. The original forbearance expired but they have now placed another unauthorized forbearance on my account on XX/XX/XXXX.
Original email : My name is XXXX XXXX loan number XXXX. We were not affected by any of the storms in my area and I did not authorize Navient to put a forbearance on my account. I do not authorize Navient to put any forbearances on my account in the future without my express consent.
I want my loans put back into the same status they were in prior to the forbearance, so I can access the payment plans available to delinquent borrowers. and my repayment options sent to me in writing.

I have currently been trying to handle an issue with Navient since the end of XXXX and a late payment that was shown regarding the account in XX/XX/XXXX. I have spoke directly with the company numerous times over the passed 2 years file a dispute originally back in XXXX once the first late payment showed. Wrote a letter explaining the conversation with the agent that stating the accounts were currently out of forbearance unbeknownst to my knowledge, I was told there shouldn't be any worry account were only showing a numbers of days passed due and that it wouldn't effect the bureau or late payment status until after 90 days. Unfortunately the way they had the accounts set up between FEDERAL XX/XX/XXXX and DEPT OF EDU loan the representative had mistakenly input the correct forbearance updates and instead place one of the loans within the incorrect month which then had a negative effect of the bureaus and did show late payment reporting.
Once notified of the late payment I spoke with supervisors about the account and they informed me to file a dispute and write a letter which was completed and sent in. I was told the accounts would be place on hold until further notice of the investigations and they could extend the forbearance timeframe for me until it was resolved. I had stated that once we could get this figured out I would gladly close out account and move on. I never received updates to the accounts of their investigation from NAVIENT but did show the account had been updated to current but late payment was never removed.
I had made numerous attempts to speak with agents about the payment history and of course every phone called took hours upon end and was told a supervisor would be in touch, which seemed to dragged out with no results. This resulted in the account being place in forbearances again and further investigation without results. It is now XXXX of XXXX and during the time frame and misinformation from numerous call centers reps this resulted in another late payment because they had stated I had ran out of forbearance time. I demanded a supervisor call me directly and needed to speak to someone directly about the investigation. A supervisor had called me and stated that upon phone conversation logs pulled they saw the discrepancy as to what happened with the originally late payment and had requested it be removed which they had requested, but now that there was a new late payment that was considered the XX/XX/XXXX instead of the Dept of Education that they couldn't remove this late payment even though I have called for months and explained what was going on stating that I could and would make the payments I just needed the accounts corrected so everything could report accurately. Supervisor stated that phone calls had been made numerous times a day from their automative system about being past due but I explained that I had spoke with agents about these calls and explained I was told the accounts where supposed to be place on hold while the results of the investigation took place. He stated that even though a mistake was made on there end that I should still keep up with the payment that showed passed due.
As of XX/XX/XXXX its a blessing and curse at the same time, I finally got in touch was someone willing to take the time and look into everything that should have been done from the beginning. They acknowledge the mistake but said the second late payment was due to my negligence. I expressed that this all originally stems from the mistake back from XXXX and I have made numerous attempts to try and get this handle so we can close out the accounts and move forward with accurate bureaus. I was told by the supervisor that if I didn't agree with the results I could file a dispute but likely would have the same results as to what I was being told on the phone. I currently was over a XXXX credit score that doesn't miss payments and now because mistake it could impact me for the next 7- 10 years. The company has stated there was a mistake they acknowledged the attempts to get the situation handled but wont fully correct appropriately the bureaus that way I can make the payments needed to close out the accounts.
please see my description as to why I'm filing this dispute. I was told this is my next option or looking into hiring a lawyer to take the next step, appreciate your time and just hoping this helps correct the accountability of the NAVIENT COMPANY.

I have been stuck in an interest loop with Navient for 2 years ( I started paying on my large loans after consolidating them through XXXX XXXX, which then turned into Navient ). Hello, On XX/XX/XXXX, I received a letter from the California State Controller 's office that a business had money that was due to me. The business is Navient Corporation ( Unclaimed Property Department - attention XXXX XXXX ) and the money due is from a settlement Navient owed in regards to my student loan repayment.

' On XX/XX/XXXX I emailed to inquire if I would still be receiving my check within the 8-10 week time frame stated. That same day I received an email from XXXX XXXX stating ; 'Your claim was processed, and a check should be arriving to you within the next 2 weeks. We appreciate your patience. ' After the two weeks passed I emailed again on XX/XX/XXXX to say I hadn't received the check and was inquiring as to when it would arrive. I would love to know how to go about investigating my loans in connection with the current lawsuit Consumer Finance has against Navient. My state has filed nothing and I am certain I could be included in this, federally and/or locally ( KY ).
Recently, first, I tried to setup my payments for auto pay so I could get the reduction in my interest rate. It took MONTHS. They kept taking the payment then kicking it back. If I were not working for my family business, I would not have had time to do all the work I did to finally get it working.
Second, I have been submitting payments via my bank ( online ), over and above the monthly payment that is being automatically deducted from my account. My account is setup to direct all overpayments to principle. They have applied them to interest. I can supply you with screen shots showing such. Their answer? I can hardly understand it but I am assuming it is being applied this way because it arrives before my payment is due and they're applying it to my payment, anyway??? This is RIDICULOUS. The last correspondence I received from them says it is being applied correctly. That is all! " Sorry about your bad luck. '' Can you advise me as to how I should proceed?

When I started to repay theses loans years ago I was encouraged to make interest only payments. It was described to me that I would be paying down a set amount of interest and when I could later afford to make higher payments, the interest owed would be paid down and I would be making payments towards the principal. Long story short, I was misled into believing I was paying down a predetermined set amount of interest. I am still paying a great deal of interest. Over the years I have paid around {$10000.00} in payments and today I owe more than I ever borrowed!

I have called numerous times and waited on hold. Ive emailed, with a response that i need to call. My online account is locked out, they just keep me in forbearance SINCE I HAD THE LOAN. University of XXXX put me in the wrong class, i told them what they did and then they just reported me to academic something for ising an exclamation point in my sentence. Now i have XXXX $ in debt from a company that ripped me off and a lender who i can not contact!! This has been going on since the company was sallie mae. How can Navient force me into forbearance for the simple fact i can not reach them. I make XXXX $ an hour and would like to pay this off. Im XXXX years old. How many more years can this go on. University of XXXX was a scam, navient is a scam. Im just a XXXX consumer.

I put my defaulted loans in rehab through XXXX XXXX and made my 9 on time monthly payments. Navient, now XXXX, says they don't know what happened and that my loans were never rehabbed. Now I'm getting letters that my taxes will be offset because my loans are still in default. Years ago, in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX I was advised to forbear my loans because I couldn't afford the XXXX a month payment. My loans were only for {$25000.00} at that time. I've reached out to Navient and XXXX XXXX to resolve this and they keep telling me to just keep making my monthly payment and eventually the loans will be picked up by a lender. I don't know what to do.

Hello, I am writing this as I am writing a complaint about my private student loans from Navient. I have paid my loans on time for 5 years straight without seeing any type of impacting decrease in the repayment. I have asked to lower my interest rates that are ridiculously high and have been told no over and over. I have asked to be on a income driven repayment plan along with just paying interest and I have also been told no.
I asked to have my loan payments be adjusted for a longer length of time to have my payments lowered and Navient has once again told me no. They have left me with no other alternatives but to only pay what I can each month. They have now affected my credit greatly and have refused every opportunity that I have asked them to help me with my situation. I have had to file for bankruptcy last year and they are still relentless on letting up on their repayment tactics. I am issuing this complaint in writing as I have no other alternative.

Ive never missed a payment, Ive been paying for years now and my balance is hardly moving. I have a 10yr payment plan.
I too, was told to take a break at one point and go for a forbarence during XXXX XXXX ( not being told Id be accruing interest ) In XXXX I called to ask about applying extra payments outside my normal payment to try and pay down my balance. She said to make an overpayment and itd go directly toward the principle. Almost a year later, I find out .... Im paying interest on the overpayments.
Next, I look further into the past payments ( auto drafted ) theyve applied {$11.00} here to principle and then {$200.00} to principle another month then back to {$100.00}, and randomly taking huge chunks of interest in a non assending order at all. Theres definitely misapplied payments and Im definitely being taken advantage of. I should have paid closer attention.
I tried to make a complaint on the website but its not working. Theyre really not helpful on the phone either.
