Complaint What Happened I have a mortgage loan with Pacific Union Financial LLC. This was a VA loan that I closed on in XX/XX/XXXX. I called XXXX XXXX customer service that following year in XX/XX/XXXX to ask them to increase my escrow amount given that the first years taxes were on my land value only and did not include my improvements ( my property ). I had an estimated bill from my county that showed the new escrow amount but they would not allow the increase. I then asked if I could send them extra funds so that there would be a sufficietn amount in escrow to pay taxes at which time they stated that any extra money would be applied to principal only. Given this outcome, I was forced to wait until XXXX XXXX paid my taxes at which time my account is now in the negative {$3000.00}. On XX/XX/XXXX I recieved an escrow analysis detailing this event and was given two options : 1. Do nothing and my mortgage increases to {$2700.00} from {$1900.00} and 2. Pay {$5500.00} and my mortgage payment increases to {$2300.00}. The problem with either scenario is that XXXX XXXX is requesting I overfund my account by over {$2500.00} dollars ; money in which they will have to return to me within 30 days according to 12 CFR 1024.17 ( f ). I called XXXX XXXX on two occasions to ask for a reanalysis and on my second call I spoke with a supervisor XXXX ID # XXXX. XXXX informed me that she understood the law but stated that it is XXXX XXXX 's proceedures to have a " cushion. '' I again explained that it is against the law for them to keep a surplus amount above the amount for my taxes and insurance needs and need the mortgage amount changed. XXXX explained that this could not happen. I then asked XXXX what would happen if I paid the {$3000.00} decficit then paid {$2300.00} and she stated that would be a partial payment and my account would be in default. Please note, my principal and interest payment is only {$1800.00} a month.
