Caine and Weiner keeps reporting inaccurate information on my credit for a debt that is not mine. I didnt receive any written notification about the debt. My credit file says its XXXX XXXX XXXXXXXX. They even noted on my credit report that original creditor cant find individual, yet they keep reporting the fraudulent information on my credit.
When I try to call them I cant verify the personal information so they cant help me. Bottom line is its not my debt and they never provided debt validation per my request, therefore the debt must be deleted from my credit report.

Received a debt collection notice from Caine and Weiner Company for a {$190.00} bill from XXXX XXXX XXXX I have never used this service and have never received any previous bills from XXXX stating I owed them any amount of money. This is a case of fraud or mistaken identity. I contacted the collection company and they want a police report in order to start a fraud claim. I do not wish to go through all the trouble when I never did this in the first place and have not had any fraudulent charges on any of my accounts that would have occurred earlier this year. I want this to be settled and do not have time to deal with this inconvenience. The collection company should drop this.

On multiple occasions I have attempted to resolve this ongoing issue of identity theft with CAINE & WEINER for fraudulently purchasing my nonpublic personal information and furnishing inaccurate and deceptive information to my consumer report via the consumer reporting agencies. This has hurt my consumer report immensely and has effected me of being approved for jobs, insurance, and dwelling. I am attaching all documentation below. I have also sent my complaint over to my state 's attorney general consumer affairs department.

XXXX have charged me for services I did not owe due to their computer software change in XXXX and XX/XX/XXXX. I have been unable to communicate with XXXX accounting during those months to rectify their mistakes in accounting. Their accounting representatives and supervisors were unable to help in anyway, and I received multiple different answers to my disputed charges. I finally contacted XXXX to resolve my dispute. XXXX resolved the dispute in late XX/XX/XXXX. I thought the matter was closed. In XX/XX/XXXX, I received a letter from Caine and Weiner Collection Agency demanding I pay {$1600.00} for the debt to XXXX. I have disputed with both XXXX and Caine and Weiner to no avail. I must dispute directly with XXXX accounting. I have tried to do contact XXXX on XXXX XXXX, XXXX and XXXX, XXXX. I continually am directed to automatic answering telling me to leave my telephone number and account number and they will return my call within four hours. I do not receive return calls from XXXX. How can receive proof I owe or provide documentation I do not owe XXXX this debt if they will not communicate with me. This has now affected my credit score. My daughter called Caine & Weiner on XX/XX/XXXX around XXXX XXXX, acting as me I guess to find info on this. They did not verify info to make sure it was me. they released to her the Creditor and the balance and continued to discuss the file with her. i did not like that this was done. So, I called them on XX/XX/XXXX around XXXX XXXX I then find out and I called them and asked straight off to spoke with a manager or supervisor, i was transferred 2 times. I spoke with a supervisor and off the bat when i explained the issue, he stated they did not have to verify and became combative. I told him before a debt collector gives any info they have to verify info to make sure they are speaking with the correct person. That is FDCPA Law. He stated what info was released to my daughter. I told him the creditor and the balance. he stated they don't have to. I told him i am in collections. He then started to ask me, first party, third party what type am I in. I told him Legal. i work for an XXXX office, the same as him. He said well then you know. i said yes i do know. I know per FDCPA that you have to verify last 4 of social and date of birth before you speak to anyone to make sure you have the correct person. I told him that i will be reporting this and that the call recordings they have will show that a violation was made. He proceed to tell me their calls maybe recorded. I told him i know all calls are recorded, that is how they can monitor if the collectors stay in compliance to the law. the hole time we were talking he was talking over me. I had told him i was reporting this issue. He did not like my response. There is no telling how many times they have broken the law. I do not appreciate my personal information given to anyone even my daughter. Verifying people is a Key point in a collectors job.

I received an email from my credit monitoring service. I saw that my credit score had dropped a tremendous amount of points. I found that CAINE & WEINER had illegally posted an alleged collection account to my credit profile. Prior to the email, I have never heard of nor had an account with this company. My report shows that it is an open account and was opened on XX/XX/2018 with a balance of {$410.00}. I have no knowledge of this company, nor this alleged debt. I have never had any dealings with this company. By federal law, a debt collector is supposed to make contact with an alleged debtor and give them 30 days to validate or dispute before they move forward with collection attempts. I never receive a letter in the mail that gave me 30 days to validate or dispute this account. I never received a letter stating that I have an alleged debt with this company and owe a balance on that account. Again, I have absolutely no knowledge of this account with them. I, a consumer defined under 15 USC 1692a ( 3 ), understand that, under the FDCPA guidelines for collection agencies, they have to provide ( 1 ) legitimate proof that they are the original holder of this debt and can legally hold me responsible for paying this debt and ( 2 ) contractual proof of obligation or an assignment SIGNED from an officer from the original creditors corporation that I am supposed to pay them. 15 USC 1692g Sec. 809 ( b ) of the Fair Debt Collection Practices Act ( FDCPA ) grants me the right as a consumer to request validation of this alleged debt they say I owe. I did not receive notice of right to dispute nor did I receive any information to verify that the alleged debt belonged to me. If I would have gotten anything in the mail or phone call from this company before they illegally reported to my credit report, I would have respectfully requested evidence that I am the person they are asking to pay this debt and a contractual obligation that legally binds me to pay them this debt. Upon them receiving my validation letter by certified mail with return receipt, they would have to legally cease from collection calls, letters, and efforts and delete the account from my credit reports until they can validate this debt. But again, I never received such a letter about this account or phone call ever in the mail because it was never sent. In order for them to prove that I received it properly, the proper letter should have been mailed certified mail with return receipt or by some form of proof of postage that would require my signature. And if the company did mail anything to me, where is the legal proof of my signature stating that I received it? Where is the return receipt or postage signature showing that I received it and signed for it? But again, I never received any sort of mail or package because it was never sent. They have illegally posted and reported to my credit file without adhering to the FDCPA laws. Im not sure if this company is a scam, but I know that this company has broken FCRA and FDCPA laws by reporting an alleged account to my credit report without informing me through mail or phone and I did not receive notice of right to dispute nor did I receive any information to verify that the alleged debt belonged to me. My credit score has dropped tremendously in the middle of making a credit transaction. Please help me get this account removed immediately. As a consumer, Im publicly publishing this descriptive complaint on consumerfinance.gov so that others can learn from my experience and so that this government agency can use this information to help work with other violations and complaints from consumers regarding this company. As a consumer defined under 15 USC 1692a ( 3 ), I'm also preparing to sue under the FCRA and FDCPA because of the numerous consumer law violations committed by this company, damages to my credit and opportunity costs with making a major purchase, and business ventures that must be delayed until this illegal account is removed. It should not my responsibility to submit proof that this debt does not belong to me. It is the responsibility of the debt collector to submit proof that they can legally collect on the alleged debt and legally report to the credit agencies. As of this date, they have failed to do so. In XX/XX/XXXX, Caine Weiner added a collection account for XXXX XXXX for {$610.00} on all 3 of my credit bureaus. I had XXXX XXXX last year and then switched companies. I contacted XXXX to inform them of the cancellation date in XXXX of XXXX. They assured me everything was cancelled and there would be no balance owed due to the insurance being paid in advance for the month. I noticed the collection in XXXX of XXXX. At which point I contacted XXXX and they informed me the agent never properly cancelled my policy. They admitted to fault and said they would send all necessary documentation to the collection agency for the account to be deleted from my bureaus. In XXXX, they were still present on my credit. I called XXXX again and they directed me to Caine Weiner. Caine Weiner directed me back to XXXX. I called XXXX again and a supervisor told me that if Caine Weiner wouldn't deleted it would have to be disputed. I tried to call Caine Weiner one more time, they told me there was no other way to delete besides paying the balance in full or settling the amount. Settling the amount would not delete the account, it would only show the derogatory account with a XXXX balance. This was not a balance that I owed, therefore I don't believe it is fair to pay a debt I don't owe or have derogatory Mark 's on my credit for an agent 's mistake.

Caine and weiner is reporting negative information to my credit without authorization, without validation or verification of debt. Without consent ( there had been no new contract drawn up ). Information and break down of the money saying I owed and what is it for. A record of all book keeping information related to this account including GAAP RECORDS. I am requesting documentary evidence on this entire account including before my personal information was sold. Caine & Weiner is participating in fraud by using my name and likeness without consent. It is a federal crime to use extortion to compel someone to behave in a certain manner. I.e negative credit reporting in hopes of a payment.

15 USC 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions.
15 U.S. Code 1681a - Definitions ; rules of construction - Exclusions.-Except as provided in paragraph the term " consumer report '' does not include any report containing information solely as to transactions or experiences between the consumer and the person making the report ; 15 USC 1666B : A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for purpose.

XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, KY XXXX XXXX XXXX XXXX XXXX XX/XX/2024 Consumer Financial Protection Bureau ( CFPB ) XXXX XXXX XXXX XXXX XXXX DE XXXX RE : Complaint Regarding Debt Collection Practices Dear CFPB, This letter is a formal complaint regarding debt collection practices for a debt allegedly owed to Caine and Weiner with the original debt with XXXX Nature of Complaint I am filing this complaint because Caine and Weiner has violated the Fair Debt Collection Practices Act ( FDCPA ) and its implementing regulation, Regulation F ( 12 CFR Part 1006 ), in the following ways : Failure to Provide Proper Validation Notice 12 CFR 1006.34 ( b ) ( 5 ) and 15 USC 1681-S2 ( 7 ) ( A ) ) I did not receive a proper validation notice from Caine and Weiner within the XXXX ( XXXX ) business days required by law. This notice should have included the amount of the debt, the name of the creditor to whom it is owed, and my rights to dispute the debt.
Failure to Disclose Method for Disputing the Debt or Requesting Original Creditor Information ( 12 CFR 1006.34 ( c ) ( 4 ) ( i ) ) The validation notice, if received, did not clearly explain how I could dispute the debt or request the name and address of the original creditor. The CFPB regulations require debt collectors to provide clear and specific prompts for these actions.
Collection Activity During Validation Period ( 12 CFR 1006.34 ( d ) ) Caine and Weiner has attempted to collect the debt before the expiration of the XXXX validation period. This period allows me to dispute the debt and restricts the collector 's ability to take further action.
Request for Relief I request that the CFPB investigate these violations by Caine and Weiner taking the following actions.
Ordering Caine and Weiner cease all collection activity until dispute is resolved.
Requiring Caine and Weiner to provide corrected validation notice with clear instructions for disputing the debt and requesting original creditor information.
Instructing the credit bureaus to delete any negative information related to this debt from my credit report if the debt is found to be inaccurate.
Additional Information I have attached copies of all relevant documents, including any communication received from Caine and Weiner regarding debt Thank you for your time and attention to this matter. I look forward to your prompt investigation and a resolution that protects my rights under the FDCPA.
