Complaint What Happened Request for Removal of Inaccurate Late Payments from Credit Report To Whom It May Concern, I am writing to dispute and request the immediate removal of inaccurate late payments listed on my credit report. Pursuant to the Fair Credit Reporting Act ( FCRA ), 15 USC 1666 ( b ), and the Fair Debt Collections Practices Act ( FDCPA ), I am entitled to have accurate information reported on my credit file. The late payments in question are inaccurately reported on my credit file and do not reflect my payment history accurately. I assert that I have never been late on any payments, as I have always been enrolled in autopay for all my accounts. The fact that a bill may have been sent to my address does not constitute proof of a late payment. The reporting of these inaccurate late payments violates my rights under the FCRA, as they do not reflect my true creditworthiness. Additionally, the reporting of false late payments may constitute a violation of the FDCPA, as it misrepresents the status\ of my accounts : late payments XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX, XX/XX/XXXX, XXXX XXXX, XX/XX/XXXX reported by CHRYSLERCAP Number XXXX Furthermore, the Truth in Lending Act ( TILA ) requires accurate reporting of credit information to ensure consumers are treated fairly and have access to credit based on accurate data. The price was XXXX by the XXXX XXXX XXXX. The interest rate came up to XXXX then the same day it went up to XXXX. They added My Wife on the contract with me. They took her off and left me on there with her income stating that I was making {$3200.00} a month but that was a lie I was only making {$2600.00} a month. Shes not on the contract its only me for the vehicle that I have is {$1100.00} a month. I was supposed to be a cosigner for My Wife the bank that they giving me is in Texas. I have no clue about Ive contacted the bank numerous times, and told them that I could not afford this vehicle I wish to trade it in, they told me I could not try the vehicle because the loan was too high Me and My Wife went to three different car lots and they told us they can not take the vehicle because it was from XXXX. Another car lot told me that were upside down because they added on XXXX more dollars on the vehicle. The bank knew all about what XXXX XXXX he did, Ive contacted freedom XXXX back in XXXX when I got the vehicle and asked him could I trade the vehicle in because the monthly bill was too high and I can not afford it anymore. I need something cheaper. I also try XXXX XXXX and my credit score is just too low for me. I dont have a license or permit, so My Wife has to drive the car, the bank is not doing anything about it. XXXX just saying that they are going to repossess the car. If I dont start making payments, I have other bills I have to pay XXXX XXXX by my own food. I cant afford that monthly payments just too high.

Complaint What Happened My car loan is no longer being reported to my credit report. It was before, but is no longer there. I still have the car loan and I am still paying on the car loan. I called Santander Consumer USA, that's who my loan is through. They told me they escalated to the credit bureau and someone would call me back in 3 business days. 4 business days passed, I thought maybe they were behind. I called back and they said everything looks normal on their end and they can see my car loan on my credit report. I tried to go trade my car in, the dealership told me there is not car loan on my credit report. Santander will not call me back and Everytime I call them, they just respond with someone will be in touch or I'm sure it will be reported at the end of the month. It's going on 3 months now.

Complaint What Happened just reaching back out I was want to let you all know that they re-Poed my vehicle tonight, XXXX XXXX didnt notice the vehicle was gone. They did not knock on the door or anything on my end. I try to refinance the truck today again at my bank. They told me that it was upside down still and they could not do it. Complaint What Happened In XXXX XXXX XXXX I couldnt make my payment by the due date and I incurred a late charge of {$29.00}. They showed my balance for XXXX at {$610.00} on XX/XX/XXXX, and I paid {$620.00}. Then I paid another {$30.00} on XX/XX/XXXX to cover the late charge. The late charged was still showing as of XX/XX/XXXX. I wrote several chat messages and called Santander about the issue and was informed that I was still late. That cant be possible when I paid {$61.00} over the {$580.00} due for the month. Santander is possibly doing this as retaliation for a complaint I filed against them with the XXXX and corporate. They also refused to honor moving a payment to the end of the loan because they knew I lost my job and the vehicle had over {$7000.00} worth of damage that needed to be paid. I asked them to move one payment to the end of the loan and they said no, even though I qualified for the move. They said they didnt feel they should do it. I asked them to moved my payment date to the XXXX of the month and they said no. So I had no choice but to be late paying the bill for XXXX. A comment was made that I probably needed the money for XXXX, which was XXXX since I never celebrate holidays. These people are so horrible. They mistreat customers and then intentionally try to set customers up to fail. There is no way I should still owe money on a late fee when I paid over by {$61.00}.

They told us they was going to buy the contract and what freedom dies put on there. The bank manager was also rude and nasty towards me and my husband. so there is no option of trading the vehicle in at all theres no refinancing the vehicle at all weve tried both. Complaint What Happened I have been trying to get a refinance on this loan and use my credit that is now better than when I signed the loan agreement. The loan has a reported payment history of XXXX months at a rate of $ XXXX which should total to around {$12000.00}. The amount that is reportedly paid is {$3000.00}. Complaint What Happened Unfortunately, the original creditors are no longer in business. I was working with Santander Consumer U.S.A. They have sold to someone else and I was never made aware of this, which is very frustrating. I had financed a XXXX XXXX XXXX through them. I was immediately reported to the credit bureaus just a few days after I purchased the vehicle. I tried to get this matter resolved but they kept saying that they would resolve and correct it. This never happened. I was sick for a while back in XXXX and I informed Santander of this and they said that they would work with me. They actually appeared like this was going to be the case. Yet, I kept making payments and they kept reporting late payments. My payments were {$480.00} per month. Due to my illness in XXXX I had fallen behind and the plandemic was affecting my job. Later in XXXX Santander was sued and lost a Civil Case. I received a letter from a lawfirm stating that my car was in this lawsuit settlement. I was informed to contact Santander pertaining to this matter. I did and they completely ignored the fact that the lawsuit settlement said my car was to be considered paid in full. We continued for months dancing around this issue. I kept trying to do the right things and the situation got way out of hand. I was even hung up on several times by their customer service agents when I would bring up these issues. Finally, I had dealt with their harassment over being called 9 times a day that I volunteered to surrender the vehicle. I was devastated because I wasn't given proper notification of the repossession and the Repo Service they sent to get the car refused to let me get my personal belongings out of the car. This was back in XX/XX/XXXX if I remember. They never contacted me about whether I wanted to try to get the car back or not. I was never given the opportunity and I could have done that. This was and still is a harmful issue for me to discuss.

Complaint What Happened I filed a complaint with Santander Consumer USA through the XX/XX/XXXX on XX/XX/year> because they did not send me a copy of the original contract like I asked the first time. They did eventually send the contract over through the XX/XX/XXXXhowever, according to the contract, the original creditor is not Santander Consumer USA. I asked Santander Consumer USA to send over the disclosure notices from the original creditor that gives them permission to share my personal information with third parties, they failed to do so. If they cant provide proof that they have permission to have my personal information from the financial institution they need to remove the account.

Complaint What Happened I am writing to dispute charges from Santander pertaining to a vehicle that was declared total and for which Gap insurance had paid it. On XX/XX/2023 my brother XXXX was driving his car on his way home which car I was a co-signer when the driver behind him accidentally hit him, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, the car was totaled. Immediately, we, notified the Gap insurance provider, and the claim was processed and paid to Santander in full, covering the remaining balance of the loan. Despite the Gap insurance payment, we have been receiving unwarranted charges and notices from Santander, indicating outstanding amounts related to the vehicle. These charges are erroneous and contradict the terms of the Gap insurance policy, which specifically covers the shortfall between the vehicle 's value and the outstanding loan balance. We have attempted to resolve this matter directly with Santander through multiple calls and written correspondence, yet, the issue persists. The result is, that we were reported to all three credit bureaus for late payments but actually all the payments were on time until this accident occurred.
